A beautiful summer day in the park watching Morgan and Tom get married.

It's an amazing thing to see a loving LEGAL gay wedding - and for it to be two of my most treasured friends? Even better!

Steven [livejournal.com profile] kitchenbeard wrote a wonderful ceremony - and it was just lovely to be witness to..... Steven had us come forth with strings and bind the two of them together! (scottish bondage - way hawt!) It really was a beautiful, memorable event.

I think it's photographs like this that are going to help convince California voters that there's really no point in voting for a "marriage amendment" in November, that it would simply be downright CRUEL to rip apart many thousands of vows that have been made by such sincere Gay couples.

As it turns out, they may not be able to vote for an amendment, due to how the law system is structured. From what I can understand, you can't have a popular vote that *creates* exclusion or prevents citizens from being treated equally under the law.

What a lot of people forget is the SCoCA didn't "vote in" gay marriage, they upheld the CA constitution which states everyone is treated equally under the law.

Chris - that's an excellent point, that of course the "Family" organizations are doing their best to twist or ignore.

I know the legal teams on both sides are going to be busy this summer and fall. I hope there is a decison/opinion that reflects your comment here.

Oh, absolutely. It is not the courts' job to uphold the precise will of the majority of the people. That's what elections are for. The job of the courts is to uphold the Constitution, regardless of whether the necessary decisions fall in line with the will of the majority. It is up to the judges to determine, without bias from the rest of the population, what constitutes equality under the law, or equal protection. It seems more than obvious to me that to exclude Gays from the institution of marriage is a clear violation of any notion of "equality," and I have yet to see anyone dispute that on a rational level. Therefore, it is not "activism" on the part of judges to declare that Gay and Straight couples should be treated equally under the law, rather it is an example of judges performing their rightful duty.
